Private Funding
When we bill clients for our services as their case progresses, we tend to refer to those cases as "privately funded". This is the old-fashioned way of paying for legal representation. It has its advantages: you do not have to account to anyone else for the way in which your claim is progressing and, because you pay for everything "up front", you can keep control over the amount that is being spent on your case. To aid this, we are very happy to set costs "ceilings", above which we will not go without your approval.
On the whole, however, you will probably find that there are ways of paying for your case that are safer and less financially draining. Clinical negligence claims - especially those that proceed all the way to Court - are very expensive, and you would have to be pretty financially secure to consider funding a claim "out of your own pocket" from beginning to end. That said, we have acted for such clients in the past, and continue to be happy to do so.
Sometimes, it is necessary to have a case funded privately in its initial stages, so that we can put together enough evidence to obtain "after-the-event" insurance cover and/or offer you a Condition Fee ("no win no fee") Agreement: see our guidance on CFAs. In cases like this, we will always work with you to ensure that you are not stuck with a bill you might struggle to pay.
